These Terms govern your use of MakeADS ("platform") operated by LINKAPP TECHNOLOGIES PRIVATE LIMITED("Company"). By accessing or using our platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and a resident of India (or an authorised representative of an Indian business) to use MakeADS. By signing up, you confirm you meet these requirements.

2. Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at contact@makeads.design if you suspect unauthorised access.
• One account per business unless you are on the Studio plan with team seats.

3. Credits & subscriptions

• Credits are consumed when you generate content. Unused credits expire at the end of each billing cycle.
• Plans auto-renew monthly unless cancelled before the renewal date.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers are unaffected until their next renewal.

4. Acceptable use

You agree not to use MakeADS to:

• Generate content that is illegal, defamatory, or violates third-party intellectual property rights
• Scrape, reverse-engineer, or otherwise attempt to extract our AI models
• Circumvent platform limits or share accounts with unauthorised users
• Generate spam, misleading advertisements, or content that violates ASCI guidelines

5. Your content & our licence

You retain ownership of all content you upload (logos, product images, catalog data). By uploading, you grant LINKAPP TECHNOLOGIES PRIVATE LIMITED a limited, non-exclusive licence to process that content solely to provide the service to you. We do not use your content to train shared models.

6. Generated content

Content generated using MakeADS is owned by you, subject to compliance with these Terms. We make no warranty that generated content is free from third-party IP claims and recommend reviewing outputs before publishing.

7. Limitation of liability

MakeADS provides the platform "as is". To the fullest extent permitted under Indian law, we are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Termination

We may suspend or terminate your account immediately if you breach these Terms. You may cancel your subscription at any time from your account settings. Refunds on termination are governed by our Refund Policy.

9. Governing law & disputes

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Ernakulam, Kerala. We encourage you to contact us first — most issues can be resolved without legal proceedings.
